Reporting Infringing Content

Under the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)), a notice of claimed infringement must be in writing and include all of the following:

  1. The physical or electronic signature of the copyright owner or a person authorized to act for the owner.
  2. A description of the copyrighted work you say has been infringed.
  3. The web address (URL) of the page or file on DrRosieDVM.com that you say infringes, with enough detail for us to find it.
  4. Your name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act for the owner.

A notice that leaves out these items may not be enough for us to act on it, and we may ask you for the missing information.

What We Do With a Notice

When we receive a complete notice, we remove or disable access to the material promptly, and we tell the person who posted it. We may send that person a copy of your notice, including your contact details.

Anyone who submits a false notice may be liable for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f). If you are not sure whether something infringes, consider speaking with a lawyer before you send a notice.

Counter-Notice

If we removed your material and you believe that was a mistake, you can send our designated agent a counter-notice that includes:

  1. Your physical or electronic signature.
  2. A description of the material that was removed and where it appeared before it was removed.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed because of a mistake or misidentification.
  4. Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the district where your address is located (or, if you are outside the United States, any judicial district where we can be found), and that you will accept service of process from the person who sent the original notice.

We send a copy of your counter-notice to the person who filed the original notice. If they do not tell us within 10 business days that they have filed a court action, we may restore the material between 10 and 14 business days after we receive your counter-notice.

Repeat Infringers

We will close the accounts of users who are repeat infringers, in appropriate circumstances.
